TERMS OF SERVICE AND SUBSCRIPTION AGREEMENT – JOB SEEKERS
1. PARTIES
1.1 CONEXAO CENTRO DE AVALIACAO PSICOLOGICA E DESENVOLVIMENTO HUMANO LTDA, a Brazilian limited liability company registered under CNPJ No. 31.123.575/0001-25, with its principal office at Rua Guerino Fontana, 335, Sala 01, Bom Jesus, Curitibanos, SC, 89520-000, Brazil, owner of the LOOK JOBS platform available at www.look-jobs.com ("LOOK JOBS"); and
1.2 The individual registered on the Site, identified by the information in their account and by their username and password ("SUBSCRIBER").
2. PURPOSE
2.1 This Agreement covers the following tools that LOOK JOBS provides to the SUBSCRIBER through www.look-jobs.com (the "Site"):
a) posting, viewing, adding and editing their resume;
b) searching for jobs;
c) sending their resume to job openings;
d) job search guidance;
e) searching for companies and viewing the contact details they publish on the Site;
f) access to content from LOOK JOBS or third parties made available by LOOK JOBS.
2.1.1 A LOOK JOBS subscription DOES NOT GUARANTEE A JOB, A JOB OFFER, OR ANY PRESENT OR FUTURE PLACEMENT OF THE SUBSCRIBER. LOOK JOBS does not charge anything related to the SUBSCRIBER being hired by an employer. The Site is only an online tool to search jobs, send resumes and use the other features of the Site.
2.2 This Agreement applies to the Parties above and to the use of the content that LOOK JOBS provides to the SUBSCRIBER. Access to the content requires acceptance of this Agreement, compliance with the Privacy Policy available on the Site and, where applicable, payment of the subscription.
2.3 The SUBSCRIBER accepts this Agreement by clicking "I HAVE READ AND AGREE" when signing up or reactivating the subscription.
2.4 If the SUBSCRIBER cannot be held legally responsible (for example, because they are a minor), the obligations of this Agreement apply to their parent or legal guardian.
2.5 The Parties accept the email address provided at sign-up as a valid means of communication, and the Site as a sufficient means of delivering content and handling any matter related to the subscription.
2.6 Access to the Job Seeker Area requires the username and password created at sign-up and is reserved exclusively for the SUBSCRIBER.
2.6.1 The SUBSCRIBER is solely responsible for keeping their username and password safe. They are personal and may not be transferred.
2.6.2 LOOK JOBS is not liable for damages resulting from third parties using the SUBSCRIBER's username and password.
2.7 Each employer is solely responsible for the content of its job posts on the Site and for any damages they may cause.
3. TERM
3.1 This Agreement has no fixed term and remains in effect while the SUBSCRIBER keeps an active account on the Site.
4. RIGHTS AND OBLIGATIONS OF LOOK JOBS
4.1 LOOK JOBS will keep the Site available 24 hours a day, 7 days a week. The SUBSCRIBER understands that, as an online service that depends on third-party telecommunications, the Site may occasionally be unavailable, and that LOOK JOBS does not guarantee uninterrupted access.
4.2 LOOK JOBS is not liable for downtime caused by connection problems with the Site, the network or the SUBSCRIBER's devices. This does not release the SUBSCRIBER from paying for the plan purchased until it ends.
4.3 LOOK JOBS may, without prior notice: perform maintenance to improve the Site's tools and content; and make changes in extraordinary or unforeseeable situations.
4.4 LOOK JOBS may remove any resume that contains false or inconsistent information or that does not comply with LOOK JOBS policies.
4.5 LOOK JOBS may close the SUBSCRIBER's account if it is proven that the SUBSCRIBER misused the Site, such as trying to access pages or data not intended for them, protected by someone else's password or located in internal areas of the Site. Any right not expressly granted to the SUBSCRIBER is reserved to LOOK JOBS.
4.6 LOOK JOBS may suspend the SUBSCRIBER's access, until the issue is resolved, if the name does not match the ID document provided (if any), if there is any other inconsistency in the account, or if a payment is overdue.
4.7 LOOK JOBS may suspend and remove employers that do not comply with the laws of the country where the job is offered or with LOOK JOBS policies. The following job posts and offers (by phone, email or any other means) are prohibited, among others:
a) those that require the SUBSCRIBER, before, during or after the hiring process, to pay any fee or amount, or to work without pay, for the employer or for third parties;
b) those involving pyramid schemes, "work from home" schemes, chain letters or any irregular or illegal activity;
c) those that are discriminatory or violate the laws of the country where the job is offered or the rights of others, including references to sex, age, race, color, religion, health condition, disability, sexual orientation, gender identity, family status, pregnancy, political opinion, national origin, social origin or any other form of discrimination, except when the nature of the job clearly requires it and local law allows it;
d) those with prior-experience requirements that violate the laws of the country where the job is offered;
e) those offering consulting services instead of a real job opportunity;
f) those using third-party data without authorization;
g) those whose job description or candidate profile does not match the business of the employer or of the company offering the job;
h) those that do not match the profile of the Site's users.
4.8 The SUBSCRIBER understands that their resume and other information on the Site may be seen by third parties, including their current or future employer, and agrees that LOOK JOBS is not liable for any damages resulting from this. The SUBSCRIBER can hide their profile from specific companies in the Job Seeker Area.
4.9 Because LOOK JOBS does not take part in negotiations between the SUBSCRIBER and third parties, the SUBSCRIBER agrees that LOOK JOBS is not liable for any losses or damages arising from those negotiations.
4.10 By accepting this Agreement, the SUBSCRIBER authorizes LOOK JOBS to keep their resume and any other information they add to the Site (such as cover letters and references) in its database, to be used only for display on the Site. The SUBSCRIBER may withdraw this authorization at any time by emailing LOOK JOBS, at no cost.
4.10.1 The SUBSCRIBER understands that employers searching for candidates or posting jobs will have access to the information described above, except for information the SUBSCRIBER marks as confidential when entering it on the Site.
4.11 Sharing Site content intended for users, paying or not, is prohibited except through links to the Site itself, whether on social media, by email or by any other means. If this rule is broken, LOOK JOBS may, at its discretion, suspend or cancel the SUBSCRIBER's access.
5. RIGHTS AND OBLIGATIONS OF THE SUBSCRIBER
5.1 The SUBSCRIBER is solely responsible for the internet access needed to use the subscription.
5.2 The SUBSCRIBER is solely responsible for:
(a) the accuracy of their account and billing information, which must always be complete and up to date;
(b) the proper use of their username and password, which are personal and non-transferable;
(c) the content and accuracy of their resume;
(d) any activity carried out under their account;
(e) their internet access, being liable for the civil and criminal consequences of any error or misconduct when using the Site; and
(f) acts committed by third parties in their name using their username and password, where the SUBSCRIBER is proven to be at fault.
5.3 The SUBSCRIBER authorizes LOOK JOBS to store their account on its servers and to share account information with:
(a) competent public authorities that formally request it, as required by applicable law; and
(b) strategic, business or technical partners, to provide and improve the Site's services. The SUBSCRIBER agrees that LOOK JOBS may collect browsing information to measure traffic, identify user profiles and guide advertising.
5.4 The SUBSCRIBER sends their resume to jobs using the tool available on the Site. LOOK JOBS does not send resumes on its own.
5.5 The SUBSCRIBER authorizes the use of their name, profile photo, resume content and other fields on the Site, without compensation, for display in areas of the Site, including the Job Seeker Area.
6. PAYMENT AND CANCELLATION
6.1 If the SUBSCRIBER does not bring their subscription up to date, LOOK JOBS will suspend their access until it is.
6.2 If the SUBSCRIBER cancels, their access remains active until the end of the plan period chosen and is then closed automatically.
7. GENERAL TERMS
7.1 The SUBSCRIBER accepts these terms by clicking "I HAVE READ AND AGREE" on the job seeker sign-up form.
7.2 By completing their account on the Site, the SUBSCRIBER grants LOOK JOBS, free of charge and revocably, the use of their account details (name, address, email, etc.) and professional information, only for internal purposes related to the Site's activities. This authorization may be withdrawn at any time by emailing LOOK JOBS.
7.3 If any provision of this Agreement is found invalid, the other provisions remain in effect, and the invalid provision will be rewritten in accordance with applicable law, without harm to the SUBSCRIBER.
7.4 The SUBSCRIBER confirms that they had access to this Agreement on the Site beforehand, with the option to print it, and that they have read and agree to all of its terms.
8. PERSONAL DATA PROTECTION
8.1 LOOK JOBS processes the SUBSCRIBER's personal data in accordance with the data protection laws that apply in the SUBSCRIBER's country of residence, including, as applicable: in Brazil, the General Data Protection Law (Law No. 13,709/2018 – LGPD); in Mexico, the Federal Law on the Protection of Personal Data Held by Private Parties; and in the United States, applicable federal and state laws.
8.2 The SUBSCRIBER understands, agrees and authorizes LOOK JOBS to process their personal data to create and maintain their account, provide support and send communications by email, phone, app and on the Site.
8.3 The SUBSCRIBER understands that their personal data, and any family members' data they provide, are collected, stored and processed according to the Site's sign-up rules, and that LOOK JOBS may share them with business partners to provide its services and comply with applicable law.
(x) I agree to receive communications from LOOK JOBS.
(x) I authorize the use of my name, image and voice on LOOK JOBS media and digital platforms, for news, educational, promotional and advertising purposes, in photo, video and audio.
8.4 To change these consents, or to access, correct or delete their data, the SUBSCRIBER can contact [email protected].
9. JURISDICTION
9.1 Any dispute will be handled in the courts of the SUBSCRIBER's place of residence, in accordance with the consumer protection laws of their country, unless the Parties expressly and freely agree otherwise.
