SUBSCRIPTION AGREEMENT
1. PARTS
1.1 On a LOOK-JOBS side, based at 7657 GOLF CHANNEL DRIVE, ORLANDO FL 32819 ("look-jobs");
1.2 On the other hand, the LEGAL ENTITY, in this act carrying the information duly registered in our database and identified by its name, through your login and password ("the RECRUITER").
2. OBJECT
2.1 The subject of this Agreement is the availability by LOOK-JOBS to the RECRUITER, through its website www. look-jobs.com ("Site"), of the following tools:
a) disclosure of job vacancies, visualization, inclusion and alteration of their curricula;
b) visualization of resumes and printing thereof;
c) disclosure of the company in the
d) access to own or third-party content made available by look-jobs.
2.1.1 The disclosure in the look-jobs does not guarantee, IN ANY CASE, PROMISE OF RECEIPT OF RESUMES OR PRESENT OR FUTURE OBLIGATION OF REPLACEMENT OR OBTAINING CANDIDATES FOR THE RECRUITER. LOOK-JOBS does not perform any activity related to other types of contracting, and the Site is only an online tool that allows the RECRUITER to register vacancies, view resumes, among other features related to the site.
2.2 This agreement relates to the Parties mentioned above and applies to the use of the content made available by the look-jobss to the SUBSCRIBER. Access to the Content by the RECRUITER is subject to acceptance of this Agreement, as well as compliance with the Privacy Policy available on the Site.
2.3 The acceptance of this Agreement will take place at the time the RECRUITER clicks the "I LI AND I AGREE TO THE CONTRACT" button on the register, in cases of reactivation of signature, expressing its full agreement with the clauses and conditions contained in this Agreement.
2.4 In the impossibility of the RECRUITER being held responsible, the obligations presented in this contract will be transferred to its legal guardians.
2.5 The Parties recognize the e-mail (e-mail) registered at the time of contracting as a valid and effective form of communication and accept the Site as sufficient to make the Content available, as well as for any other issue related to the subscription.
2.6 It will be necessary to enter login and password (duly registered at the time of the registration) to access the "Recruiter Area", reserved exclusively for the RECRUITER for access to all inherent resources and tools.
2.6.1 The RECRUITER will be solely responsible for the custody and maintenance of your login and password, which is personal in nature and non-transferable, for all legal purposes.
2.6.2 The RECRUITER's access to the Site, i.e. the login and password, are known to you and exclusive use, and the look-jobs will not be responsible for any damages arising from access by third parties or hackers, using the recruiter's login and password.
2.7 It is emphasized that the content of the job advertisements contained in the Site are the sole and exclusive responsibility of the respective advertisers, who will bear the civil and criminal penalties arising from the losses they may generate.
3. TERM
3.1 This Agreement will be held for an indefinite period, remaining valid for as long as the RECRUITER keeps his/her login and password active on the Site.
4. LOOK-JOBS DUTIES AND RIGHTS
4.1 LOOK-JOBS will allow the RECRUITER access 24 (twenty-four) hours a day and 07 (seven) days a week, however, it recognizes that because it is an online tool may eventually interrupt or suspend access, which is why LOOK-JOBS does not guarantee access in a completely uninterrupted manner, in view of the dependence on telecommunications services provided by third parties and susceptible to failure.
4.2 Look-jobs reserves the right to: perform any maintenance in its systems, aiming at improvements in the quality of tools and content made available, regardless of prior notice; modifications, regardless of prior notice, when there are extraordinary or unpredictable situations.
4.4 LOOK-JOBS reserves the right to exclude any registration that presents inveracities, data divergences or that are not compatible with the LOOK-JOBS policies.
4.5 LOOK-JOBS may delete the RECRUITER and his/her login and password record, if any undue procedure is proven by him/ her, such as attempting to access or access pages or data not specifically intended for him or her, which are not clearly available to the public, that are of reserved use or protected by the password of others, that have any type of access limitation or that are in internal directories of the Site, being certain that any right not expressly granted to subscriber and/ or candidates users of the Site in general is reserved exclusively to look-jobs.
4.6 The look-jobs may also suspend the recruiter's access, if any divergence involving the name and number of CNPJ/CPF provided by the RECRUITER is found, or, in case of any other inconsistency in its registration or cases of default, until its regularization.
4.7 In this same sense, with respect to the advertised vacancies, look-jobs reserves the right to suspend and exclude from its system advertisers who do not comply with current rules and legislation and that do not comply with the policies of the look-jobs. Ads, telephone, e-mail or any other electronic means are expressly prohibited:
a) who require the SUBSCRIBER, as a condition for participation in the advertised selection process - before, during or after its termination, the payment of any fee or value, or, further, the provision of services without due remuneration, either for the recruiting company or for third parties;
b) that referred to pyramids, "work at home" system, partnerships, chains, irregularities, illegalities or immorality;
c) that contain prejudiced connotation, socially excluding or that in any way contravenes the Federal Constitution and its principles, the legislation in force or, even, the right of third parties, and therefore not being allowed job advertisements in which there is reference to sex, age, race, religion, health conditions, sexual option, family situation, state of pregnancy, political opinion, nationality, social origin and any other forms of discrimination, except where the nature of the activity to be carried out, publicly and notoriously, so requires;
d) who require or require the candidate to the vacancy proof of previous experience for more than six months in the same type of activity;
(e) offering consultancy services other than a real employment opportunity;
(f) using third-party data without proper authorisation;
g) that the description of the vacancy and/or professional profile requested are not consistent with the branch of activity of the advertiser or the company holding the advertised vacancy;
h) To share the profile of subscribers of the Site, or that they are related to particular services, such as diarists, among others.
4.8 Considering that look-jobss does not participate in any recruiter negotiations with SUBSCRIBERS, the Recruiter expressly acknowledges and agrees that look-jobss cannot be held liable for losses and damages of any kind that may be known as a result of such negotiations, whether contractual, non-contractual or of any other nature, to it or third parties.
4.9 By adhering to this Agreement, the RECRUITER expressly authorizes look-jobs to keep its registration in its database, as well as any other information that the RECRUITER may include on the Site. The RECRUITER is aware and agrees that he/she may revoke such authorization by simple e-mail communication to look-jobs at any time without prejudice.
4.10 The RECRUITER is aware that companies that are looking for candidates or including vacancies will have access to the information mentioned in the previous clause, with the exception of those that the RECRUITER actually indicates as confidential at the time of the insertion of the data on the look-jobs platform.
4.11 It is already forbidden to share the content available on the look-jobs site intended for paying or non-paying users, except if by links from the look-jobs site itself, whether on social networks, by e-mail, or any other means of disclosure, in this case the look-jobs may, in its sole discretion, suspend or cancel the recruiter's access.
5. SUBSCRIBER DUTIES AND RIGHTS
5.1 It is the sole and exclusive responsibility of the RECRUITER to access the worldwide network of computers (internet), which must provide it in order to be able to enjoy the site.
5.2 The RECRUITER shall be solely responsible for:
(a) the veracity of your data;
(b) the correct use of your login and password, which are for professional use and non-transferable;
(c) for any activity that occurs within the scope of its access;
(d) for your access to the Internet, thus answering in isolation for any civil and/or criminal burdens and/or sanctions that may result from error or demeanor may be committed by the SUBSCRIBER when using the Site; and yet yet
(e) for acts that third parties practice on your behalf, through the use of your login and access password, provided that the fault or deed of the RECRUITER is proven.
5.3 The RECRUITER expressly authorizes that the registration mentioned in the previous item is made and maintained by the look-jobs on its servers, as well as the provision of the information contained in its registration to:
(a) competent public authorities who formally request them, pursuant to the U.S. Federal Constitution and applicable legislation; and
(b) strategic, commercial or technical partners, including but not limited to the possibility of offering better conditions for the resources of their Products/Solutions. The RECRUITER expressly declares its agreement regarding the collection of information by look-jobs to perform traffic monitoring, in order to identify user profile groups and for advertising guidance purposes.
5.4 The RECRUITER will be responsible for sending resumes to the vacancies registered on the Site, since this is not done unilaterally by look-jobs, and the SUBSCRIBER must use the online tool available on the Site to do so.
5.5 The RECRUITER must pay the look-jobs the amount corresponding to the contracted payment plan, respecting the dates and periodicity reported, according to the option made by the SUBSCRIBER at the time of registration on the Site.
5.6 The RECRUITER authorizes in this act the use of his name, profile picture, content inserted in his resume and in other fields available on the site, without any financial compensation. Subscriber agrees that your data may be displayed in the applications available on the look-jobs website, including but not limited to the Candidate Area.
6. GENERAL CONDITIONS
6.1 The clauses presented in this agreement will be accepted from the moment the RECRUITER expresses his agreement in the applicant registration by clicking on the EU LI button AND I AGREE TO THE CONTRACT.
6.2 The RECRUITER, when filling out the registration on the Site with his data, information and including his registration, cedes and transfers, in a precarious and free way, his registration information (name, address, e-mail, etc.) and professionals for the look-jobs, authorizing the use of this data only for internal purposes and related to the activities of the Site. At any time this authorization may be revoked by the RECRUITER, through simple e-mail communication lookjobs.usa@gmail.com to look-jobs.
6.3 The invalidity or invalidity of any of the provisions of this agreement shall not result in the nullity or invalidity of the other provisions, and the provisions subsequently considered null or void shall be rewritten in accordance with applicable law, without prejudice to the RECRUITER.
6.4 The RECRUITER expressly declares, by this instrument, that he has taken prior notice of this Agreement on the look-jobs Site, including the possibility of printing it, and that he has evaluated, read and agrees with all the provisions and clauses described herein.
7.0 TERM OF ACCESS THE GENERAL DATA PROTECTION LAW
7.1 In compliance with law no. 13,709/18 - General Data Protection Law, Referring to the processing of personal data, including in digital media, the declarant informs that he has science, agrees and authorizes look-jobs, for registration purposes and maintenance, to enable the service whenever necessary, as well as for sending communications and information by look-jobs, whether by email, phone, application and website, messaging and digital media.
I am aware that the capture, storage, manipulation and editing of my personal data is being carried out in compliance with the General Standards of Qualification of the site look-jobs.
The look-jobs can share my data with business partners to enable their services and compliance with current legislation.
(x) I authorize the receipt of the communication of the look-jobs.
(x) I authorize the use of my name, image, voice in media and digital dolook-jobs platform, for journalistic, educational and advertising purposes; for promotional material and advertising, by reproduction in photo, video and audio.
If the declarant wishes to change the consents set out, he/she must request it in the customer relationship area or by e-mail.
The deletion of your data should be requested by e-mail lookjobs.usa@gmail.com
8th FORO
8.1 In the form of the Law, the consumer's foreplay shall prevail, unless the Parties expressly, and willingly, agree with another.
